American Automobile Association sues owner of AAAclubs.xxx and ...

AAA sues to stop adult entertainment site from using AAA in its name.

The American Automobile Association, commonly known as AAA or ?Triple A?, has sued the owner of AAAclubs.xxx, AAAclubs.com, AAAclubs.net, and AAAclubs.us.

According to the lawsuit (pdf), AAA became aware of the defendant in December 2011 when it filed a trademark application for ?AAA Clubs of America? for use in conjunction with discount programs. AAA offers discount programs to its membership.

AAA contacted the defendants the next month and believed that they had acquiesced.

The lawsuit alleges that in December 2012, AAA discovered that the defendants had ?transitioned into the business of online pornography? with its AAAclubs.xxx domain name.

Hence, the lawsuit.

The plaintiff is asking for $100,000 per domain under the anti-cybersquatting act, and that the defendant cancel its registration of the domains.

Public university funds event to help female students have orgasms

The University of Minnesota, Twin Cities ? the #68-ranked national university in all the land, according to U.S. News ?? is paying a two self-proclaimed sex and relationship educators $3,406 to give an on-campus presentation designed to help female undergrads have better orgasms.

?Join us to laugh and learn about the ?big O,?? says the program description on the University of Minnesota?s official events calendar. ?Orgasm aficionados and beginners of all genders are welcome to come learn about everything from multiple orgasms to that mysterious G-spot.?

According to Campus Reform, the website that first reported the story, the university had previously asked readers: ?Are you coming?? However, that provocative question has apparently been scrubbed from the school?s taxpayer-funded website.

The University of Minnesota?s Women?s Center, a branch of the Office of Diversity and Equity, will host the event. It will be open to both male and female students.

No age requirement is listed in the description. Patricia Mattern, a university spokesperson, told Campus Reform that there is no age requirement for the event.

?As a research institution, we study, publish and educate on a vast range of topics, including human sexuality,? she added, noting that the rationale for the $3,406 fee is the university?s research mission.

The self-proclaimed sex educators who will give the presentation are lanky-looking Brown graduates Marshall Miller and Dorian Solot. Like hypnotists and a variety of bush-league comics, they travel to colleges and universities of all sizes performing this well-rehearsed event and a few others.

Marshall Miller and Solot also own a company called Sex Discussed Here.

According to their website, their programs ?use a mixture of interactive activities, lecture, discussion, multimedia, funny stories, and question and answer.?

The Female Orgasm in particular offers a ?playful, honest approach to this topic, packing the house on college campuses.? Among the issues addressed ?the problems with pressure to have an orgasm, to orgasm faster, to have multiple orgasms, to orgasm with a partner, to fake or not fake orgasms.?

?Since we?ve answered thousands of college students? questions about sex, we have a pretty good sense of what people are wondering about,? the website adds.

The site also offers hats, t-shirts and posters for sale. Most of these items profess love for female orgasms.

TV ads may be driving children to drink ? The Chart - CNN.com Blogs

The halls of every middle school in America are filled with teenagers looking to find themselves, express themselves and fit in with the crowd. But it?s what happens at home, at night, that can lead to some of the problems those teens may put on display.

Seventh-graders who are exposed to alcohol ads on television ?- and who say they like the ads - may experience more severe problems related to drinking alcohol later in their adolescence, according to a study published Monday in the medical journal Pediatrics.


The study

Researchers at the School of Community and Global Health at Claremont Graduate University in California hypothesized that ?adolescents who like alcohol advertisements will be more likely to elaborate on the content of the ads (e.g., imagine themselves in the scene), and as a result, they will be more likely to be persuaded to try the product.?

As consenting adult consumers,?the more appealing an advertised product is, the more likely?it will be?purchased. Secondly ?? drinking is oftentimes thought of as cool, rebellious ? sometimes even an ?adult? thing to do. These two notions, taken together, can be a recipe for problems when it comes to children and alcohol.

Participants were recruited from 23 randomly-selected public middle schools in Los Angeles County. The seventh-grade students were preliminarily surveyed as to how often they watched 20 popular TV shows. Data on alcohol advertising during these programs was subsequently obtained from Nielsen Media Research.

The study?s authors then conducted follow-up surveys, which included still pictures from the television advertisements, none of which contained any brand names or logos. An open-ended item asked participants to write down what product was being advertised; independent judges decided whether responses were indeed related to the advertisement or not.

The survey also included three items to assess how much participants liked the alcohol ads they viewed on TV. The teens were asked if they thought the alcohol ads were funny or sexy, and whether they liked the alcohol ads better than other ads. ?These items,? explain the authors, ?measure an affective or emotional reaction to alcohol ads that has been useful in both the study of alcohol advertising and by the advertising industry in general to estimate the potential effectiveness of advertising copy.?

Results

?Exposure to advertising was found to have a significant correlation with alcohol use, particularly among girls,? the study concludes. ?Liking the ads was connected with alcohol-related problems (defined as not being able to do homework, getting into fights, neglecting responsibilities, or causing someone shame or embarrassment), particularly in boys. For both boys and girls, the more they were exposed to the ads and liked them, the more their alcohol use grew from seventh to 10th grade.? That, of course, leads to a greater potential for alcohol-related problems later on.

The researchers were also careful to consider additional factors, such as the total amount of time spent watching television, observing friends drinking, observing well-known adults drinking, age, gender, ethnicity, language, parents? occupation and education, as well as enrollment?in extracurricular sporting activities.

Asked for a response by CNN, Anheuser-Busch referred questions to the Beer Institute.

"The brewing industry is deeply committed to responsible advertising practices, and actively works to reduce the underage drinking rate to zero," the institute said in a statement Wednesday. "In fact, we developed one of the first voluntary advertising guidelines to help our members advertise and market their products in a responsible manner, including targeting adults of legal drinking age ... At the end of the day, we support the timeless value of parents talking to their children about making good, safe decisions."

Recommendations

The study's authors recommend teaching children about "the design of persuasive messages in the media?to help the avoid undue influence by the media on their behaviors. Second, it is?important to have a comprehensive policy to limit the exposure of children to alcohol ads on television and on other media."

The urgency of finding a solution to the epidemic of underage drinking was underscored further by another study released Monday in Pediatrics. Researchers at the National Institute on Alcohol Abuse and Alcoholism found that in 2010, 36% of 10th graders drank, 28% binged, and 23% were drunk in the past month. Although 82% of the high school sophomores reported seeing a doctor in the past year, only 54% were asked about drinking, and just 17% were advised to reduce or stop drinking.

?Efforts are warranted to increase the proportion of physicians who follow professional guidelines to screen and counsel adolescents about unhealthy alcohol use and behaviors that pose health risks,? conclude the second study?s authors.

Did Alex Rodriguez use performance enhancing drugs?

A Miami paper says Alex Rodriguez (ARod) of the New York Yankees purchased human growth hormone (HGH) and other banned substances from a Miami clinic.

?Major League Baseball said it is "extremely disappointed" about new allegations of performance-enhancing drug use against Alex Rodriguez and other players contained in a newspaper report.

The Miami New Times, a popular alternative weekly, said in a story Tuesday that it had obtained files through an employee at a recently closed clinic in south Florida that show Rodriguez purchased HGH and other substances.

"We are always extremely disappointed to learn of potential links between players and the use of performance-enhancing substances. ... Through our Department of Investigations, we have been actively involved in the issues in South Florida," MLB's statement said.

Rodriguez, the New York Yankees slugger currently recovering from hip surgery, has admitted using steroids from 2001-03 but insisted he stopped after that.

"We fully support the Commissioner's Joint Drug Prevention and Treatment Program. This matter is now in the hands of the Commissioner's Office," the Yankees said in a statement. "We will have no further comment until that investigation has concluded."

Other players named by the New Times as appearing in the records at Biogenesis include Melky Cabrera, Gio Gonzalez, Bartolo Colon and Nelson Cruz. Cabrera, the All-Star game MVP for the San Francisco Giants last season, was suspended 50 games in August for failing a drug test. The outfielder has signed with the Toronto Blue Jays as a free agent.

Colon, a pitcher for the Oakland A's, was also suspended 50 games in August.

Gonzalez, who went 21-8 for the Washington Nationals last season, and Cruz, who hit 24 home runs for the Texas Rangers, had not previously been linked to performance-enhancing drugs.

The Rangers said in a statement that after being contacted by the New Times late last week, they notified Major League Baseball. The club said it had no further comment.

Gonzalez posted on his Twitter feed: "I've never used performance enhancing drugs of any kind and I never will, I've never met or spoken with tony Bosch or used any substance."

The report said that the notes of clinic chief Anthony Bosch list the players' names and the substances they received, including human growth hormone and steroids. Several unidentified employees and clients confirmed to the publication that the clinic distributed the substances, the paper said. The employees said that Bosch bragged of supplying drugs to professional athletes but they never saw the sports stars in the office.

Any player found by MLB to use banned, performance-enhancing substances, is subject to suspension.

Armed Arizona posse guards schools: Vigilantes or vigilance?

From a distance, the Maricopa County sheriff's patrol car parked near the entrance to a school parking lot suggests the presence of a uniformed deputy, sitting vigilant behind the wheel ? a 9 millimeter Glock on his waist, a Remington shotgun nearby, and a bulletproof vest snug under his tan shirt.

But the man behind the wheel is no deputy.

He is retiree David Bennett, a volunteer with the armed posse that Sheriff Joe Arpaio recently dispatched to patrol school zones in metropolitan Phoenix. It is the sheriff's answer to keeping students safe in the aftermath of the Newtown, Conn., school shootings in December that left 26 people dead, including 20 children.

It is also at least a glimpse of how schools might look if the National Rifle Association had its way. In the wake of the Sandy Hook Elementary massacre in Newtown, the NRA proposed putting armed guards at the entrance of every school. It vowed to help train ex-cops and other volunteers for the task. Here in Phoenix, Sheriff Arpaio has essentially already taken the lead.

School administrators did not respond to calls requesting comment, but among the parents interviewed, the response was favorable.

"I think it's good for the community, I think it's good for the schools," says Karen Brinkman, who has children in Maricopa County public schools. "There needs to be a presence there."

But critics accuse the publicity-prone Arpaio of exploiting the school tragedy for self-promotion. They also question the effectiveness of random patrols outside school grounds without input from school administrators and state government.

"The events in Newtown should be addressed by the governor, legislature, and county and local officials," Randy Parraz, president of Citizens for a Better Arizona, said in a statement.

In her State of the State speech earlier this month, Gov. Jan Brewer (R) proposed more resources to place armed officers inside schools but opposed the idea of arming teachers, as some people across the country have suggested.

Arpaio says trying to get various groups to agree on the best way to tackle school safety could take months. And he saw fit to take quick action on his own.

"Unfortunately, you've got a lot of politics involved in this," he says.

Patrolling outside schools in communities north of Phoenix is just the latest job for members of Arpaio's posse ? many of them retirees like Mr. Bennett. Seeking extra help for his department, Arpaio created the posse in 1993 to patrol malls during the holiday season. Today, they check in when people call police worried about someone's health or safety, transport injured inmates to hospitals, and help with traffic control. They also provide security during the sheriff's controversial workplace raids targeting immigrants working in the country illegally.

A local CBS affiliate, KPHO-TV, investigated the posse and found some volunteers have a criminal history that includes offenses such as assault, drug possession, and domestic violence. More than 400 of the 3,000 posse members carry firearms.

The sheriff stands by his posse and says its saves millions in taxpayer money. The same taxpayers would be responsible for any mishaps involving posse members while on the job.

Mr. Bennett pays little attention to the criticism surrounding the posse's latest assignment. He notes that members always work under the supervision of deputies.

"The deputies do the heavy lifting," he says. "We do the clean-up work, you might say."

Bennett is prepared for the worst. But chances are slim that he will find himself in a situation precarious enough to warrant use of his weapons, he says. In his 10 years with the posse, he has not fired a single shot while on duty.

"I hope I never do, but in the event that that would happen, one must be trained in how to and when to," he adds.

Whatever the job, Bennett says his duty is to respond to the sheriff's orders and make sure "that I'm making contributions to the community."

With that in mind, the building contractor signed up for the posse a decade ago as he eased into semi-retirement. He went through various levels of training for nearly a year, including 100 hours on firearms alone to earn his certification. Like all posse members, he had to buy his uniform, guns, handcuffs, and other equipment. He spent about $3,000.

These days, Bennett devotes much of his time to the posse. Last year, he put in 2,000 hours on posse business, he says, about half on patrol and half on administrative work as commander of his area's volunteer group of some 60 members. They take turns watching for anything suspicious around 14 schools in the communities they patrol.

When children and school principals wave as he makes his rounds, he feels good about his service.

"As posse members, we are the eyes and ears of the community," he says.

Miles away, Luis Fuerte is at Frank Elementary School ? one of 59 schools on the posse patrol list ? to pick up his little boy and goddaughter. Recently, he was shaken by the arrest of a 10-year-old boy, who was threatening to stab a student at the school. So he has no qualms about having the posse keep an eye out.

"If my kids are safe, then that makes me feel a lot better," he says.

According to the research, published today (Jan. 29) in the journal Nature Communications, cats kill between 1.4 billion and 3.7 billion birds and between 6.9 billion and 20.7 billion small mammals, such as meadow voles and chipmunks.

Though it's hard to know exactly how many birds live in the United States, the staggering number of bird deaths may account for as much as 15 percent of the total bird population, said study co-author Pete Marra, an animal ecologist with the Smithsonian Conservation Biology Institute.

Staggering toll

Marra and his colleagues are looking at human-related causes for bird and wildlife deaths in the country, from windmills and glass windows to?pesticides.

But first, Marra and his team looked at the impact of the feline population, one of the biggest putative causes of bird demise in the country. ? ? ??

While past studies had used?critter cams?or owner reports to estimate the number of birds killed by cats, those studies were usually small and not applicable to the entire country, Marra told LiveScience.

For this broader analysis, the team first looked at all prior studies on bird deaths and estimated that around 84 million owned-cats live in the country, many of which are allowed outdoors. [In Photos: America's Favorite Pets]

"A lot of these cats may go outside and go to 10 different houses, but they go back to their house and cuddle up on Mr. Smith's lap at night," Marra said.

Based on an analysis of past studies, the researchers estimated that each of those felines killed between four and 18 birds a year, and between eight and 21 small mammals per year.

But the major scourges for wildlife were not those free-ranging, owned-cats, but instead feral and un-owned cats that survive on the streets. Each of those kitties ? and the team estimates between 30 million and 80 million of them live in the United States ? kills between 23 and 46 birds a year, and between 129 and 338 small mammals, Marra said.

And, it seems, the small rodents taken by felines aren't Norway rats or apartment vermin, but native?rodent species?such as meadow voles and chipmunks, he added.

No easy answers

One obvious step to reduce the mass wildlife death is to keep kitties indoors, Marra said.

Perhaps seeing their furry friends bring in a meadow vole or a cardinal will spur cat owners to say, "Listen,?Tabby, we're going to have a heart-to-heart talk about how much time you spend outside," he said.

Wild cats pose tougher questions, because capture and sterilization approaches have varying levels of success depending on the community, said Bruce Kornreich, a veterinarian at Cornell University's Feline Health Center, who was not involved in the study.

While keeping owned-cats indoors is the best way to benefit both kitties and wildlife, a?complete cat ban, like the one recently proposed in New Zealand, is probably not the answer, he said.

For one, it's not clear how?completely removing cats?from outdoors would affect the ecosystem.

"It may be in some cases that cats may also be keeping other species that may negatively impact bird and other small mammal populations in check," Kornreich told LiveScience.

As you chatter on your smartphone, the death toll rises?almost 7 million birds are killed each year when they fly into communication towers that make cellphone conversations possible. Worse, the towers often kill birds that are already rare. So says a study in the journal Biological Conservation. [Travis Longcore et al, Avian mortality at communication towers in the United States and Canada: which species, how many, and where?]

For example, tower impacts kill more than 2,000 yellow rails per year. That's roughly 9 percent of the total population. Ninety-seven percent of all birds killed are songbirds, especially warblers. The red-eyed vireo suffers some of the biggest losses, some 581,000 deaths annually, though that represents less than 1 percent of its population.

The Southeast and Midwest lead the country in tower-bird collisions. That's because these regions have the largest concentrations of the tallest towers, up to 900 feet high. While all of the more than 80,000 communication towers in North America cause problems, the roughly 1,000 tallest towers cause 70 percent of the bird deaths, luring birds to their doom with red warning lights that are always on.

A partial solution is relatively simple: replacing the always-on red lights with blinking ones could cut the deaths by as much as 70 percent. Otherwise, Twitter could have a monopoly on tweets.

Dayton budget funds innovative scholarships for low-income ...

Buried in Gov. Mark Dayton $37.9 billion proposed budget is a creative idea to improve the lives of the state?s most educationally vulnerable children: state-funded scholarships for preschoolers from low-income families.

It?s an idea early on proposed by Art Rolnick, former research director at the Federal Reserve Bank of Minneapolis, pushed by advocates for the poor for years and that has shown to be successful in a limited pilot program.

Dayton on Tuesday asked legislators for $44 million over two years for the early-learning scholarships for preschoolers, a move that?s drawing praise from an education-reform group and advocates for the poor.

?This is farther than we?ve seen any governor in recent history go,?? said Anita Patel, vice president racial justice and public policy at the YWCA of Minneapolis.

Ericca Maas, who heads Parent Aware for School Readiness, said she was happy to see Dayton's budget included scholarships, which she described as a proven idea and pointed out that?children are waiting. She stressed the need for high-quality programs "to make sure we get maximum return on taxpayer investment.?

Still, the numbers in the governor?s budget fall far below the need, say advocates, who want quality learning opportunities for all the state?s needy 3- and 4-year-old children.

The importance of early childhood education has long been recognized, but the political will and financing to implement programs for all children in Minnesota is building slowly.

?First we want to say how happy we are that the governor took this step and recognized the need for early childhood education,?? said Frank Forsberg, chairman of the Executive Committee of MinneMinds, a statewide coalition of foundations, non-profits and businesses banded together to ask for a learning boost for preschoolers whose families are at or below 185 percent of the poverty line.

?Definitely a step in the right direction,?? concluded Daniel Sellers, executive director of MinnCAN, an education reform group that is also a member of MinneMinds (pronounced minnie-minds).

Missing an opportunity

But the experts agree the governor?s proposal doesn?t come close to meeting the needs of Minnesota?s low-income preschoolers ? MinneMinds sought $185.2 million over the biennium ? and some argue the state is missing an opportunity for big payoffs later.

They cite research that shows that for every $1 spent on high-quality preschool programs, $16 is saved down the line because youngsters enter school ready to learn rather than falling behind the learning curve. Advocates point to a Minnesota Early Learning Foundation report released in 2011 on the benefits high-quality preschool programs and emphasize that up to 90 percent of brain development occurs by age 5.

With proper preparation, they say, children are more likely to graduate from high school and college, acquire good jobs and become good citizens.

That?s why Sellers? organization is standing by the coalition?s initial request. ?By investing more now we can have even bigger returns,?? Sellers said.

Support for the idea has been growing for years. In? the early 2000s, representatives from business and nonprofit leaders formed the Minnesota Early Learning Foundation (MELF) to research? how to cost-effectively prepare children for kindergarten, relying in part on the work and recommendations of Rolnick and Rob Grunewald in a Federal Reserve Bank of Minneapolis report, which supported early learning scholarships. Learning advocates called for development of an educational rating system as well.

In 2011, MELF and a bipartisan group legislators backed legislation incorporating scholarships and standards. The Legislature appropriated some funding, but it was the Dayton administration that implemented a standards rating system.??????

Competition for money

But like every budget, there?s competition for a piece of the pie. Dayton has proposed for the 2014-2015 budget $40 million for optional all-day kindergarten, ?$20 million for increased access to quality child care as well as the $44 million for early learning scholarships.

?This is a debate between three good options,? Sellers said. All three are important investments, he said, but MinnCAN argues that early action and tying resources to accountability is most critical and that more money should go to preschool scholarships as advocated by MinneMinds.

Under the group?s proposal, which would receive funding in the Dayton budget, parents apply based on income and select the child-care or early-education provider they want for their child. But they must choose from certain ?quality?? learning programs.

That means only early education programs, childcare providers and preschools receiving certification from Parent Aware, a kind of early education seal of approval system and a program in the state Office of Early Learning.? Programs are rated along high standards: stimulating learning environments, age-appropriate curriculums, teacher training and parent communication.?

Under a pilot program, Toniesha Thompson was given a scholarship to pay for her daughter Talaysia?s childcare at New Horizon Academy in Minneapolis, a center with Parent Aware credentials.

The first two weeks the child was there, the then-3-year-old learned her numbers and letters and started singing nursery rhymes, mom says. When the family lived in Texas, she and her baby sister had spent their days with grandma and adults. Now they spend their days interacting with other children, playing games and learning and have become very outgoing.

?Thanks to the scholarship, I?ve been able to keep up with rent, pay bills and put some money aside,?? said Thompson, formerly homeless in Minneapolis, but now in transitional housing as she gets on her feet. She works as a cook at her children?s childcare center and is studying to become a nurse.

Thompson?s other child, Natalia, 2, is also at the center and she hopes there is funding to pay her tuition as well.?

Play with Languages ? Using Languages in Computer Games ...

On Friday 18th of January pupils from across Yorkshire and the Humber were invited to take part in a pilot event called ?Play with Languages ? using Languages in Computer Games? at The University of Hull. As the name suggests, the main focus of the day was to motivate pupils and showcase how computer games can be played in different languages and how there are many careers which languages can lead on to, including the gaming world.

30 Year 10 pupils from three schools attended the event: Sydney Smith School, Beverley Grammar School and Bridlington School. The day commenced with a lively introduction from Kerry Dobson, Co-Director of Routes into Languages Yorkshire and The Humber, and then pupils were split into two French groups.

The first language session of the day introduced pupils to computer specific language and technical jargon when using a keyboard and computer. Then they were introduced to RuneScape, the popular fantasy game, which they would be using and playing throughout the day. They got stuck into building their own fantasy characters practising language specific descriptions for hair, clothes, body parts and accessories. They also learnt how to describe enemies and use arms to help them in their game quest, such as spells. Then it was the lunch break which gave the students an opportunity to take a campus tour and they got a glimpse into student life here at the University of Hull.

The second session of the day focused on writing descriptions of their fantasy characters and looking at the game from a French angle. The last part of the day was used to let the pupils have a ?treat? and play the game in English.

The day was a great success as pupils gave very positive feedback and commented that the day had be ?Excellent?,? ?Fun? and even ?Interesting?! Plans are in progress to repeat the event at a later date. Happy gaming!

Sen. Kerry tackles questions on Iran, Syria, Hagel at hearing

WASHINGTON (AP) ? Sen. John Kerry, President Barack Obama's nominee for secretary of state, collected pledges of support Thursday and testified at his confirmation hearing that U.S. foreign policy should be defined by a helping hand as well as military strength.

The Massachusetts Democrat discussed Iran, Syria, climate change and a variety of issues with members of the Foreign Relations Committee at a hearing that recalled an unusual American life ? son of a diplomat, Navy lieutenant who volunteered for Vietnam, anti-war protester, five-term senator, unsuccessful nominee for president, and Obama's unofficial envoy.

The nearly four-hour hearing also provided an odd juxtaposition as Kerry, a member of the panel for 28 years and its chairman for the last four, sat alone in the witness chair. At one point, Sen. Bob Menendez, D-N.J., the incoming chairman who presided, mistakenly referred to Kerry as "Mr. Secretary."

The current secretary, Hillary Rodham Clinton, introduced Kerry, calling him "the right choice." She is stepping down after four years.

The committee is expected to approve Kerry's nomination early next week, and a full Senate vote could occur before the month is out.

"American foreign policy is not defined by drones and deployments alone," Kerry said in outlining his views. "We cannot allow the extraordinary good we do to save and change lives to be eclipsed entirely by the role we have had to play since Sept. 11, a role that was thrust upon us."

Kerry spoke out strongly for dealing with climate change, providing food and energy security and humanitarian assistance. He also spoke of robust foreign aid, but he insisted that the country must get its fiscal house in order to lead in the world.

"More than ever, foreign policy is economic policy," said Kerry, who described himself as a "recovering member of the supercommittee." That bipartisan panel failed in 2011 in its mandate to come up with a deficit-cutting plan.

Faced with Iran's nuclear program, Kerry said the United State will do what it must to prevent Tehran from obtaining a nuclear weapon, but he also signaled that diplomacy remains a viable option.

"I repeat here today: Our policy is not containment. It is prevention, and the clock is ticking on our efforts to secure responsible compliance," Kerry said.

The senator said he was hopeful that the U.S. and other nations could make progress on the diplomatic front, but that Tehran needs to relent and agree to intrusive inspections.

"If their program is peaceful, they can prove it," he said.

In an unexpected exchange, Kerry found himself defending Obama's pick of Republican Chuck Hagel to be the next defense secretary against GOP criticism.

Sen. Bob Corker, the senior Republican on the panel, expressed concerns about Hagel's support for an 80 percent reduction of U.S. nuclear weapons, a major issue for the Tennessee lawmaker and his home state. The Y-12 nuclear facility is located near Oak Ridge, Tenn., and any cuts or delays in modernization to the nuclear arsenal would have an impact on local jobs.

"I know Chuck Hagel. And I think he is a strong, patriotic former senator, and he will be a strong secretary of defense," Kerry said.

The Massachusetts senator urged lawmakers to be realistic, arguing that an 80 percent cut is an aspiration that would be unlikely in the current climate.

On Syria, Kerry was asked about his outreach to President Bashar Assad, now an international pariah after months of civil war and unending violence against his citizens.

Kerry said there was a moment where Syria reached out to the West but that the moment has long passed.

"History caught up to us. That never happened. And it's now moot, because he has made a set of judgments that are inexcusable, that are reprehensible, and I think is not long for remaining as the head of state in Syria," the senator said. "I think the time is ticking."

Sen. John McCain, R-Ariz., a fierce critic of Obama's policy on Syria, said the status quo is unacceptable with the United Nations estimating that 60,000 have been killed and the heavy influx of refugees in Jordan and Turkey.

After a recent visit to the refugee camps, McCain warned that Syrians frustrated with the U.S. response will be a recruitment target for extremists.

"We can do a lot more without putting American boots on the ground," McCain said. "Otherwise, we will be judged harshly by history."

Kerry said it was imperative to continue discussions with Russia and others in dealing with Syria but that "I don't have optimism."

Menendez noted that Kerry, if confirmed, would be the first senator on the panel in a century to ascend to the Cabinet post. President William McKinley appointed Ohio Sen. John Sherman secretary of state.

The job of the nation's top diplomat would be the realization of a dream for the 69-year-old Kerry, whom Obama passed over in 2008 when he chose Clinton. When Joe Biden became vice president, Kerry replaced the former Delaware senator as chairman of the committee.

Obama nominated Kerry after Susan Rice, the U.S. ambassador to the United Nations, removed her name from consideration following criticism from Republicans over her initial comments about the attacks on the U.S. Consulate in Benghazi, Libya.

Corker told Kerry, "You've almost lived your entire life for this moment."

The Vietnam War, a long, bitter conflict that took its toll on a generation of draft-age American men, played a prominent role at the hearing.

In his testimony, Kerry alluded to his controversial moment before the committee some 42 years ago, when the decorated Vietnam veteran testified about his opposition to the war and famously asked, "How do you ask a man to be the last man to die for a mistake?"

"Today I can't help but recognize that the world itself then was in many ways simpler, divided as it was along bi-polar, Cold War antagonisms," Kerry said. "Today's world is more complicated than anything we have experienced."

McCain, who also introduced Kerry, said their friendship took root with their work on a committee seeking to resolve the status of POWs and missing in action from Vietnam as well as efforts to ensure normal U.S. relations with Vietnam during President Bill Clinton's administration.

"Helping to establish a relationship with Vietnam that serves American interests and values, rather than one that remained mired in mutual resentment and bitterness, is one of my proudest accomplishments as a senator, and I expect it is one of John's as well," McCain said.

The hearing is the first of three for Obama's national security nominees, and the least controversial. Hagel will face tough questions about his past statements on Israel, Iran, nuclear weapons and defense spending at his confirmation hearing next Thursday before the Senate Armed Services Committee. John Brennan, the president's choice for CIA director, will be quizzed about White House national security leaks and the use of unmanned drones at his hearing next month.
